Terms of Service

These Terms apply to pixaverse.art and play.pixaverse.art (“Pixaverse”).
1) The service
Pixaverse is a browser-based game and gallery experience. The core experience can be used without an account. Some features are optional and require additional input or sign-in.
2) Optional features
Optional account-based features, such as Cloud Save and Wishlist Sync, require sign-in and the data needed to provide those features. If you choose to use them, the related processing is described in our Privacy Policy.
3) Newsletter (optional)
The Pixaverse Chronicle newsletter is opt-in only. You can unsubscribe at any time using the link in each email or by contacting us.
4) Acceptable use
You agree not to misuse Pixaverse, including attempting to disrupt the service, bypass security controls, interfere with normal operation, scrape or systematically extract content or data without permission, or automate abusive requests.
5) Availability and changes
We may modify, suspend, or discontinue features in whole or in part where this is reasonably necessary, for example for maintenance, security, technical changes, or product development. Mandatory statutory rights remain unaffected.
6) Limitation of liability
We are liable without limitation for intent and gross negligence, for damages resulting from injury to life, body, or health, and where liability is mandatory under applicable law.
In cases of slight negligence, we are liable only for the breach of an essential contractual obligation whose fulfilment is necessary for the proper provision of the service and on which users may regularly rely. In that case, liability is limited to the foreseeable damage typical for the contract at the time the obligation was breached.
Any further liability is excluded to the extent permitted by law. Mandatory statutory rights, including mandatory consumer protection rights, remain unaffected.
7) Intellectual property and usage restrictions
All original Pixaverse artworks, original music and soundtracks, writing, worldbuilding, UI, branding, and original game assets are protected by copyright and other applicable rights.
Unless we explicitly state otherwise in writing, you may not copy, reproduce, redistribute, republish, publicly display, transmit, adapt, create derivative works from, scrape, resell, license, distribute, or commercially exploit any original Pixaverse content. This does not limit any use that is expressly permitted by mandatory law or by separate third-party licenses that apply to specific materials.
8) Consumer dispute resolution (Germany)
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
9) Governing law
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer and have your habitual residence in another country, mandatory consumer protection provisions of that country remain unaffected.
